LOYALTY PROGRAMME REGULATIONS

VN Orchid Club

§ 1. Programme Organiser

  1. The organiser of the “VN Orchid Club” loyalty programme is Vanda Novak spółka z ograniczoną odpowiedzialnością, entered in the register of entrepreneurs of the National Court Register under KRS number 0000712700, NIP: 6751632399, REGON: 369217883, with its registered office in Kraków (31-511), ul. Rakowicka 11, share capital PLN 10,950, hereinafter referred to as the “Organiser” or “Vanda Novak”.
  2. The Organiser may be contacted:
    1. by e-mail: shop@vandanovak.com;
    2. by telephone: +48 502 177 712;
    3. in writing at the following address: Vanda Novak sp. z o.o., ul. Rakowicka 11, 31-511 Kraków, Poland.
  3. These Regulations set out the rules of participation in the “VN Orchid Club” loyalty programme, in particular the rules for collecting points, obtaining club levels, using benefits, exchanging points for rewards and submitting complaints.
  4. The Programme is operated in the online store available at vandanovak.com and in the Vanda Novak physical boutique at ul. Mokotowska 51/53 in Warsaw.

§ 2. Definitions

For the purposes of these Regulations, the following terms have the meanings set out below:

  1. Programme — the “VN Orchid Club” loyalty programme operated by the Organiser.
  2. Participant — a natural person who has joined the Programme under the terms set out in these Regulations.
  3. Customer — a person making purchases in the Online Store or Boutique.
  4. Online Store — the Organiser’s online store available at vandanovak.com.
  5. Boutique — the Vanda Novak physical boutique at ul. Mokotowska 51/53 in Warsaw.
  6. Customer Account — an account created by the Customer in the Online Store, enabling participation in the Programme and viewing information about the Programme, subject to the rules applicable to the Orchid Black level.
  7. Points — accounting units granted to the Participant in the Programme under the terms set out in these Regulations. Historical Points are allocated on the basis of orders placed from 1 July 2025.
  8. Status Points — points used to determine the Participant’s club level. Status Points correspond to points obtained for purchases during their validity period, excluding points cancelled, adjusted or reversed in accordance with these Regulations.
  9. Exchangeable Points — points available in the Participant’s balance, which may be exchanged for rewards or vouchers in accordance with these Regulations.
  10. Level — one of the Programme levels: Orchid Essence, Orchid Bloom, Orchid Signature or Orchid Black.
  11. Benefit — a benefit granted to the Participant in connection with participation in the Programme, in particular a discount, voucher, possibility of early access to a collection, invitation to a special campaign or another benefit indicated in these Regulations or in individual communication from the Organiser.
  12. Voucher — a one-time discount coupon granted in exchange for a specified number of Exchangeable Points, entitling the Participant to a reduction of the purchase price by a specified amount. A Voucher is not a gift card, money voucher, payment instrument or electronic money within the meaning of the applicable legal provisions.
  13. Birthday Discount — a one-time discount granted to the Participant on the occasion of their birthday, provided that the Participant has provided their date of birth. The Birthday Discount may be granted only once in a calendar year.
  14. Material Reward — a product indicated by the Organiser, which may be issued to the Participant in exchange for a specified number of Exchangeable Points.

§ 3. Participation in the Programme

  1. Participation in the Programme is voluntary and free of charge.
  2. A Participant in the Programme may be an adult natural person with full legal capacity who:
    1. creates a Customer Account in the Online Store or is registered in the Programme in the Boutique;
    2. accepts these Regulations;
    3. provides the data necessary to participate in the Programme, in particular first name, surname and e-mail address;
    4. meets the remaining conditions set out in these Regulations.
  3. The Programme is intended for consumers. Entrepreneurs may participate in the Programme only if the Organiser expressly makes such possibility available.
  4. One Participant may have only one account in the Programme. It is prohibited to create multiple accounts in order to obtain additional points, discounts or benefits.
  5. Points, vouchers, discounts and benefits are assigned to the Participant and may not be sold, transferred to third parties, made available to third parties or exchanged for cash.
  6. Participation in the Programme does not exclude or limit any Customer rights arising from legal provisions.

§ 4. Joining the Programme and communication

  1. Joining the Programme takes place:
    1. by registering a Customer Account in the Online Store and accepting these Regulations; or
    2. by declaring the wish to participate in the Programme in the Boutique and accepting these Regulations in the manner made available by the Organiser.
  1. An integral element of the Programme is communication related to its functioning and operation, including in particular providing the Participant with information about:
    1. joining the Programme;
    2. the number of Points;
    3. the Level obtained and any change of Level;
    4. granted Vouchers, discounts, Material Rewards and other Benefits;
    5. the validity period of Points, discounts, Vouchers or other Benefits;
    6. changes to the Regulations, suspension or termination of the Programme;
    7. complaints, security of the Customer Account and other matters necessary to perform the Programme participation agreement.
  2. Independently of the communication concerning the operation of the Programme referred to in section 2, the Organiser may, after meeting the conditions arising from applicable law, provide the Participant with commercial and marketing information concerning the Organiser’s products, services, collections, events and special campaigns; promotions, sales, discount codes and offers available in the Online Store or Boutique; early access to selected collections, models or sales; and offers, recommendations and Benefits according to the Participant’s Level.
  3. Marketing communication may be conducted, depending on the consents granted by the Participant, by electronic means, in particular by e-mail, text messages or another method.
  4. Consent to receive marketing communication is not a condition for joining the Programme. The Participant may at any time refuse to grant consent, withdraw consent already granted or object to the processing of their personal data for direct marketing purposes, without affecting the possibility of further participation in the Programme and using Points and Benefits.
  5. Withdrawal of consent or lodging an objection does not affect the lawfulness of actions taken before the withdrawal of consent or lodging of the objection.
  6. Resignation from marketing communication may be made in particular by using the unsubscribe link included in an e-mail message.
  7. The Organiser may operate a newsletter service independently of the Programme, on the basis of separate regulations or rules made available when subscribing to the newsletter. In such case:
    1. joining the newsletter does not require joining the Programme;
    2. resignation from the Programme does not automatically result in resignation from the newsletter ordered separately by the Participant;
    3. resignation from the newsletter does not automatically result in resignation from participation in the Programme;
    4. the Participant may resign from each of these services independently.
  8. The Organiser may analyse information concerning the Participant’s activity in the Programme, in particular purchase history, the number of Points collected and used, the Level obtained, discounts, Vouchers and Material Rewards used, and preferred product categories, in order to:
    1. properly accrue Points and determine the Participant’s Level;
    2. grant Benefits provided for in these Regulations;
    3. prevent abuse and ensure the security of the Programme;
    4. prepare analyses concerning the functioning of the Programme;
    5. tailor offers, recommendations, marketing communication and additional Benefits to the Participant’s interests — if the Organiser has an appropriate legal basis for such activity.
  9. Profiling does not produce legal effects concerning the Participant and does not similarly significantly affect the Participant. Automatic determination of the number of Points, Level or availability of a Benefit on the basis of objective criteria set out in these Regulations does not deprive the Participant of the right to lodge a complaint and obtain verification of the determinations made by the Organiser.
  10. Providing the date of birth is voluntary, but necessary to receive the Birthday Discount. Failure to provide the date of birth or its deletion does not affect the possibility of participating in the remaining part of the Programme.
  11. The Participant should keep the contact details provided in connection with participation in the Programme up to date. The Organiser is not liable for the inability to provide information or a Benefit resulting from incorrect or outdated data provided by the Participant, except in cases where the Organiser’s liability cannot be excluded under applicable law.

§ 5. Accrual of Points

  1. For purchases made in the Online Store or Boutique, the Participant receives Points according to the following rule: PLN 1 gross actually paid for products covered by the Programme = 1 Point.
  2. Points are not granted for delivery costs of Products and other costs that do not constitute the product price.
  3. Points are accrued on the gross value of purchased products after applying discounts, discount codes, vouchers, promotions and other reductions.
  4. Points are not accrued on:
    1. delivery costs;
    2. payment fees, if any;
    3. products or services excluded from the Programme by the Organiser, of which the Customer will be informed before purchase;
    4. the purchase of gift cards.
  1. Points are accrued 25 days after the order is paid. The Organiser may mark points as temporary until:
    1. the expiry of the period for withdrawal from a distance contract;
    2. completion of the return or order cancellation procedure;
    3. confirmation that the purchase has not been reversed, returned or cancelled.
  2. In the event of a product return, withdrawal from the contract, order cancellation, acceptance of a complaint resulting in a refund of the price, or another reduction in the value of the purchase, the Organiser may appropriately cancel or adjust the Points granted for that purchase.
  3. If the Participant has used Points that should subsequently be cancelled or adjusted, the Organiser may reduce the Participant’s future Exchangeable Points balance or refuse to grant another reward until the balance is settled.
  4. Points do not constitute a payment instrument, electronic money, payment tool or cash equivalent. Points may not be exchanged for cash.

§ 6. Validity of Points

  1. Points are valid for 24 months from the date of the Participant’s last purchase, unless these Regulations provide otherwise.
  2. If, within 24 months from the date of the last purchase, the Participant does not make another purchase, unused Points accumulated in the Participant’s Account expire and the Points balance is reset to zero.
  3. Making a purchase before the expiry of the period referred to in section 1 extends the validity of all unused Points accumulated in the Participant’s Account by another 24 months, counted from the date of that purchase.
  4. After Points expire, the Participant loses the possibility of using them, and expired Points are not subject to reinstatement, exchange for cash or any compensation, unless these Regulations provide otherwise.
  5. Exchangeable Points with the shortest remaining validity period are used first.
  6. The Organiser may inform the Participant about the upcoming expiry date of Points, in particular via the Customer Account or by e-mail.
  7. In the case of the Orchid Black level, Points do not expire and are valid indefinitely for the period during which the Participant holds Orchid Black status, unless the Programme is terminated in accordance with these Regulations.

§ 7. Programme Levels

  1. The Programme includes the following Levels:
    1. Orchid Essence;
    2. Orchid Bloom;
    3. Orchid Signature;
    4. Orchid Black.
  1. The Participant’s Level, except for the Orchid Black level, is determined on the basis of the number of Status Points collected by the Participant.
  2. A Participant who has collected fewer than 1,000 Status Points may collect Points but does not yet have Orchid Essence, Orchid Bloom or Orchid Signature level.
  3. The Programme Levels are determined as follows:
    1. Orchid Essence — from 1,000 to 2,999 Status Points;
    2. Orchid Bloom — from 3,000 to 8,999 Status Points;
    3. Orchid Signature — from 9,000 Status Points;
    4. Orchid Black — a level granted exclusively by individual invitation of the Organiser.
  4. Upgrade to a higher Level takes place after the Participant reaches the required Status Points threshold, taking into account any adjustments, returns and cancellations.
  5. The Organiser may inform the Participant about a change of Level via the Customer Account, by e-mail or in another manner used in communication with the Participant.
  6. Exchanging Exchangeable Points for a Voucher or Material Reward does not result in the loss of Status Points, unless the Points are subsequently cancelled or adjusted in connection with a return, cancellation of the purchase or another ground indicated in these Regulations.

§ 8. Orchid Essence Level

  1. Orchid Essence is the first Programme Level and is available to a Participant who has collected at least 1,000 Status Points but fewer than 3,000 Status Points.
  2. Upon obtaining Orchid Essence level, the Participant receives a one-time welcome discount of 5% on purchases.
  3. The welcome discount:
    1. is valid for 30 days from the date it is granted;
    2. may be used in the Boutique upon presenting the e-mail message confirming the discount, or in the Online Store in accordance with the instructions provided by the Organiser;
    3. cannot be combined with other promotions, discounts, discount codes, vouchers or special campaigns, unless the Organiser expressly decides otherwise;
    4. is one-time only and may not be exchanged for cash.
  1. A Participant at Orchid Essence level may receive a Birthday Discount of 5%.
  2. The Birthday Discount at Orchid Essence level:
    1. is valid for 7 days from the date it is granted;
    2. applies in the Boutique upon presenting the e-mail message and in the Online Store;
    3. cannot be combined with other promotions, discounts, discount codes, vouchers or special campaigns, unless the Organiser expressly decides otherwise.
  3. A Participant at Orchid Essence level may receive invitations to selected special campaigns of the Organiser, subject to the required consents for marketing communication.

§ 9. Orchid Bloom Level

  1. Orchid Bloom is the second Programme Level and is available to a Participant who has collected at least 3,000 Status Points but fewer than 9,000 Status Points.
  2. Upon upgrading from Orchid Essence to Orchid Bloom, the Participant receives a one-time purchase discount of 10%.
  3. The upgrade discount:
    1. is valid for 30 days from the date it is granted;
    2. may be used in the Boutique upon presenting the e-mail message confirming the discount, or in the Online Store in accordance with the instructions provided by the Organiser;
    3. cannot be combined with other promotions, discounts, discount codes, vouchers or special campaigns, unless the Organiser expressly decides otherwise;
    4. is one-time only and may not be exchanged for cash.
  1. A Participant at Orchid Bloom level may receive a Birthday Discount of 10%.
  2. The Birthday Discount at Orchid Bloom level:
    1. is valid for 7 days from the date it is granted;
    2. applies in the Boutique upon presenting the e-mail message and in the Online Store;
    3. cannot be combined with other promotions, discounts, discount codes, vouchers or special campaigns, unless the Organiser expressly decides otherwise.
  3. A Participant at Orchid Bloom level may obtain early access to selected collections and sales of the Organiser, subject to product availability, the rules of the given campaign and the required consents for marketing communication.

§ 10. Orchid Signature Level

  1. Orchid Signature level is available to a Participant who has collected at least 9,000 Status Points.
  2. Upon upgrading from Orchid Bloom to Orchid Signature, the Participant obtains a fixed purchase discount of 10%.
  3. The fixed Orchid Signature discount:
    1. applies in the Online Store and in the Boutique;
    2. cannot be combined with other promotions, discounts, discount codes, vouchers or special campaigns, unless the Organiser expressly decides otherwise;
    3. may not be exchanged for cash;
    4. is available only to a Participant holding Orchid Signature status.
  1. In the Boutique, the Participant may be asked to confirm their identity in order to verify the right to the fixed Orchid Signature discount. Verification takes place by presenting an identity document for inspection. The Organiser does not copy or record data from the identity document.
  2. A Participant at Orchid Signature level may receive a Birthday Discount of 15%.
  3. The Birthday Discount at Orchid Signature level:
    1. is valid for 7 days from the date it is granted;
    2. applies in the Boutique upon presenting the e-mail message and in the Online Store;
    3. cannot be combined with other promotions, discounts, discount codes, vouchers or special campaigns, unless the Organiser expressly decides otherwise.

§ 11. Orchid Black Level

  1. Orchid Black is a special, individual Programme Level available exclusively on the basis of an invitation from the Organiser. Reaching a specified number of Points, purchase value or any other single criterion does not automatically create the right to Orchid Black level.
  2. The Organiser decides whether to send an invitation taking into account the overall relationship between the Participant and the Vanda Novak brand, in particular the history, frequency and value of purchases, duration of the relationship with the brand, interest in limited collections and individual services, brand-related activity, as well as the possibility of providing the Participant with an appropriate scope of Concierge services. These criteria are exemplary, assessed jointly, and meeting them does not guarantee receiving an invitation.
  3. The Participant has no claim to be granted Orchid Black level.
  4. A Participant at Orchid Black level receives access to individually selected benefits, which may include in particular:
    1. a fixed purchase discount of 10%;
    2. care of a dedicated Vanda Novak Concierge;
    3. telephone or e-mail contact according to the Participant’s preferences;
    4. access to limited models;
    5. the possibility of arranging private shopping in the Boutique outside standard opening hours, after prior arrangement of the date with the Organiser;
    6. other individual benefits indicated by the Organiser.
  5. Access to limited models depends on their availability and does not guarantee the possibility of purchasing a specific product. Private shopping outside the Boutique’s standard opening hours requires prior arrangement of the date and is organised taking into account staff availability and the organisational possibilities of the Boutique.
  6. If Orchid Black level is obtained, Points are not visible in the Customer Panel, unless the Organiser decides otherwise.
  7. Points of a Participant at Orchid Black level are valid indefinitely for the period during which the Participant holds Orchid Black status.
  8. The Organiser may terminate Orchid Black status for valid reasons, in particular in the event of:
    1. a breach of these Regulations;
    2. abuse of Benefits;
    3. providing false data;
    4. actions contrary to good practices or infringing the rights of the Organiser, its employees, associates or other customers;
    5. termination or a material change to the rules of operation of Orchid Black level.
  9. Termination of Orchid Black status does not affect rights acquired by the Participant before the date of termination of the status, unless they were granted as a result of abuse, error, provision of false data or breach of these Regulations.

§ 12. Discounts and rules of use

  1. Discounts granted under the Programme apply only within the scope and period indicated in these Regulations or in individual communication provided to the Participant.
  2. Discounts cannot be combined with other promotions, discounts, discount codes, vouchers, markdowns, special campaigns or sales, unless the Organiser expressly decides otherwise.
  3. Discounts may not be exchanged for cash, refunded, sold or transferred to a third party.
  4. A discount may be used only by the Participant to whom it was granted.
  5. In the event of a return of a product purchased using a discount, the price is refunded taking into account the price actually paid after the discount.
  6. If the Customer effectively withdraws from the contract with respect to part of the products covered by the order, the price actually paid for the returned product is refunded, after taking into account the discount assigned to that product.
  7. If a discount was applied jointly to the entire order, its value is assigned to individual products proportionally to their prices applicable before the discount was applied, unless the terms of a specific promotion, made available to the Customer before the conclusion of the contract, clearly specify a different method of assigning the discount.

§ 13. Exchange of Points for Vouchers

  1. The Participant may exchange Exchangeable Points for Vouchers according to the following rules:
    1. 1,500 Exchangeable Points — Voucher worth PLN 50;
    2. 3,000 Exchangeable Points — Voucher worth PLN 100;
    3. 6,000 Exchangeable Points — Voucher worth PLN 200.
  1. Exchange of Exchangeable Points for a Voucher takes place through the Customer Account, in the Online Store, in the Boutique or in another manner made available by the Organiser.
  2. After Exchangeable Points are exchanged for a Voucher, the number of Exchangeable Points in the Participant’s balance is reduced by the number of Points required to obtain the given Voucher.
  3. A Voucher is valid indefinitely and is single-use, which means that once used it cannot be used again.
  4. A Voucher may be used in the Online Store or in the Boutique, unless the content of the Voucher provides otherwise.
  5. A Voucher may not be exchanged for cash. If the value of purchases is lower than the value of the Voucher, the difference is not paid out to the Participant.
  6. A Voucher may not be used to cover delivery costs.
  7. A Voucher cannot be combined with other promotions, discounts, discount codes, vouchers, markdowns, special campaigns or sales, unless the Organiser expressly decides otherwise.
  8. A Voucher may not be sold, transferred to a third party or used by a person other than the Participant to whom it was granted.
  9. In the event of a return of a product purchased using a Voucher, the price is refunded in the amount actually paid by the Participant. The Organiser may restore the Voucher to the Participant or restore the appropriate number of Exchangeable Points if the return was made in accordance with applicable law and the Organiser’s sales rules.

§ 14. Exchange of Points for Material Rewards

  1. The Participant may exchange 6,000 Exchangeable Points for a Vanda Novak key ring, if the key ring is available under the Programme.
  2. A Material Reward is available while stocks last, unless the Organiser expressly decides otherwise.
  3. The Organiser may specify the available variants of the Material Reward, in particular colour or model.
  4. Exchange of Exchangeable Points for a Material Reward takes place through the Customer Account, in the Online Store, in the Boutique or in another manner made available by the Organiser.
  5. After Exchangeable Points are exchanged for a Material Reward, the number of Exchangeable Points in the Participant’s balance is reduced by the number of Points required to obtain the Material Reward.
  6. A Material Reward may not be exchanged for cash or for another product, unless the Organiser decides otherwise or such obligation arises from legal provisions.
  7. If the Material Reward becomes unavailable after Points have been exchanged, the Organiser will restore the Exchangeable Points to the Participant or propose another reward of a similar nature, if possible. The Participant may refuse to accept a substitute reward.
  8. A Material Reward may be:
    1. collected in person in the Boutique, at no additional cost;
    2. sent to the address indicated by the Participant, in which case the delivery cost of the Material Reward is borne by the Participant in accordance with the current delivery costs indicated by the Organiser before the exchange of Points is approved;
    3. attached to an order placed by the Participant in the Online Store, if the Organiser makes such option available and the Material Reward is available at the time the order is fulfilled.
  9. If the Material Reward is attached to an order, the rules and delivery costs applicable to that order apply. If the order meets the conditions for free delivery, the Participant does not bear an additional delivery cost for the Material Reward.

§ 15. Abuse and breaches of the Regulations

  1. The Participant is obliged to use the Programme in accordance with these Regulations, legal provisions and good practices.
  2. The following are prohibited in particular:
    1. creating multiple accounts in order to circumvent the rules of the Programme;
    2. using other persons’ data, in particular personal data;
    3. selling, transferring or commercially making available points, vouchers, discounts or benefits;
    4. taking actions aimed at unauthorised accrual of Points;
    5. providing false data;
    6. actions infringing the rights of the Organiser, its employees, associates or other customers.
  1. In the event of a breach of these Regulations, the Organiser may:
    1. refuse to grant Points;
    2. cancel Points granted contrary to these Regulations;
    3. refuse to issue a Voucher, Material Reward or another Benefit;
    4. suspend the Participant’s participation in the Programme;
    5. exclude the Participant from the Programme.
  2. The measures referred to in section 3 are applied after analysing the circumstances of the specific case. The Organiser will inform the Participant about the reason for applying the measure and will enable the Participant to submit a complaint.

§ 16. Resignation from participation in the Programme

  1. The Participant may resign from participation in the Programme at any time.
  2. Resignation from participation in the Programme may take place by:
    1. sending an e-mail to: shop@vandanovak.com;
    2. submitting a statement in the Boutique;
    3. using a function available in the Customer Account, if such function has been made available.
  1. Resignation from the Programme results in the closure of participation in the Programme and the loss of unused Points, vouchers and benefits, unless mandatory provisions of law provide otherwise.
  2. Resignation from the Programme does not automatically result in deletion of the Customer Account in the Online Store, unless the Participant also requests deletion of the Customer Account and such deletion is possible in accordance with legal provisions and the Online Store regulations.

§ 17. Complaints concerning the Programme

  1. The Participant may submit a complaint concerning the Programme, in particular the accrual of Points, Level, Voucher, Material Reward or another benefit.
  2. A complaint may be submitted:
    1. by e-mail to: shop@vandanovak.com;
    2. in writing to the Organiser’s address: Vanda Novak sp. z o.o., ul. Rakowicka 11, 31-511 Kraków, Poland;
    3. in the Boutique.
  3. A complaint should contain at least:
    1. the Participant’s first name and surname;
    2. the e-mail address assigned to the Customer Account or participation in the Programme;
    3. a description of the matter;
    4. the Participant’s request;
    5. documents or information justifying the complaint, if the Participant has them.
  4. The Organiser considers the complaint within 14 days from the date of its receipt.
  5. The response to the complaint will be provided in the same form in which the complaint was submitted, or in another manner agreed with the Participant.
  6. The provisions of these Regulations concerning complaints do not limit the Participant’s rights arising from legal provisions, in particular consumer rights.

§ 18. Amendments to the Regulations

  1. The Organiser may amend the Regulations for valid reasons, in particular in the event of:
    1. a change in legal provisions affecting the Programme;
    2. a change in the functionality of the Programme, Online Store or Programme service system;
    3. a change in the Organiser’s offer;
    4. introduction of new benefits, levels, rewards or rules for accruing Points;
    5. the need to prevent abuse;
    6. the need to clarify provisions of the Regulations;
    7. a change in the Organiser’s data.
  1. An amendment to the Regulations does not infringe the rights acquired by Participants before the amendment enters into force, unless the amendment is beneficial to the Participant or results from mandatory provisions of law.
  2. The Organiser will inform Participants about an amendment to the Regulations before it enters into force, by sending information to the Participant’s e-mail address or publishing information in the Customer Account.
  3. A Participant who does not accept an amendment to the Regulations may resign from participation in the Programme before the date on which the amendment enters into force.
  4. Points, vouchers and benefits granted before the date on which the amendment to the Regulations enters into force are governed by the previous rules.

§ 19. Suspension or termination of the Programme

  1. The Programme is operated for an indefinite period, unless the Organiser decides otherwise.
  2. The Organiser may terminate the Programme for valid reasons, in particular in the event of:
    1. a change in the sales model or brand strategy;
    2. termination of the Online Store or Boutique operations;
    3. material organisational, technical or legal changes;
    4. the inability to continue operating the Programme under the existing rules.
  3. The Organiser will inform Participants about termination of the Programme at least 7 days before the planned date of termination of the Programme.
  4. In the period from the announcement of termination of the Programme until the date of its termination, Participants may use collected Exchangeable Points in accordance with these Regulations, unless mandatory provisions of law or objective circumstances prevent such use.
  5. After termination of the Programme, unused Points, vouchers and benefits expire, unless the Organiser decides otherwise or mandatory provisions of law provide otherwise.

§ 20. Personal data

  1. The Organiser is the controller of the Participants’ personal data.
  2. Participants’ personal data is processed in particular for the purpose of:
    1. enabling participation in the Programme;
    2. accruing Points;
    3. determining the Participant’s Level;
    4. granting and handling vouchers, discounts, Material Rewards and other benefits;
    5. handling complaints;
    6. pursuing or defending against claims;
    7. conducting marketing communication — only to the extent permitted by law and in accordance with the consents granted.
  1. The legal basis for processing personal data is in particular:
    1. performance of the Programme participation agreement;
    2. a legal obligation imposed on the Organiser;
    3. the Organiser’s legitimate interest, in particular handling complaints, ensuring the security of the Programme and pursuing or defending against claims;
    4. the Participant’s consent — to the extent required by legal provisions, in particular for selected forms of marketing communication.
  2. Providing data marked as mandatory is necessary to participate in the Programme. Providing the date of birth is voluntary, but necessary to receive the Birthday Discount.
  3. Personal data will be stored for the period of participation in the Programme, and after its termination for the period required by law or necessary to establish, pursue or defend against claims.
  4. The Participant has the right of access to data, rectification of data, erasure of data, restriction of processing, data portability, objection to processing and withdrawal of consent to the extent that processing is based on consent.
  5. The Participant has the right to lodge a complaint with the President of the Personal Data Protection Office.

§ 21. Final provisions

  1. The Regulations are available in the Online Store and in the Boutique.
  2. Matters not regulated by these Regulations are governed by generally applicable provisions of Polish law.
  3. The Regulations do not exclude or limit the rights of a Participant who is a consumer, which they are entitled to under mandatory provisions of law.
  4. If any provision of the Regulations proves invalid or ineffective, this does not affect the validity of the remaining provisions of the Regulations.
  5. The Regulations enter into force on 18 July 2026.
